Who owns the rights for the 'made for BBC Scotland' programs?

I was watching catchpoint on the iPlayer (don't ask) last night and I saw the program was made for BBC Scotland.  So this got me wondering who owns the rights for the 'made for BBC Scotland' programs?  I ask this as if the SNP get their way and set up SBS does that mean the right of catchpoint go to SBS rather than the rest of the BBC? So if the BBC wanted to continue showing catchpoint they would have to pay a fee to SBS?  Or would SBS only own the made for Scotland programming?  I know catchpoint is made in Scotland but I think it's also network Scotland commission.

I wasn't speculating about the referendum at all. I ask a simple questions asking who owns what.

Worth noting that Guardian article is from 2013. Since then there's been the launch of the BBC Scotland channel. Given today's political announcement I think it's reasonable to suggest that channel was designed to deal with that.

Your post was not clear. By rights what do you mean? Transmission rights? The BBC fully ‘owns’ the rights to very few programmes and I imagine BBC Scotland does not ‘own’ anything other than News etc.

If you mean who will have the transmission rights post independence, I imagine that would be a negotiation with any future Scottish national broadcaster. I can’t imagine the bbc would want to sign away network rights to programmes that happened to be produced ‘for’ bbc Scotland for quota reasons

The Rights are owned on the same basis as for any other BBC commission for PSB.

Lets just say that the setting up of the SBS out of the BBC requires so many people to agree
including the Queen in Council and then a host of other bodies like the CMA as well as OFCOM being invled

They have to win the vote first! There's no guarantee SBS will inherit anything. Indeed, they and STV may find themselves in a bidding war for BBC and ITV programmes.

Coronation Street on SBS One and EastEnders on STV are not unrealistic propositions.
